class=\"s4\">une cliente d<\/span><span class=\"s4\">e<\/span> <span class=\"s4\">l<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">Etude<\/span><span class=\"s4\"> de Me PELLETIER<\/span><span class=\"s4\">.<\/span> <span class=\"s4\">Si l<\/span><span class=\"s4\">\u2019acte <\/span><span class=\"s4\">d<\/span><span class=\"s4\">e vente <\/span><span class=\"s4\">mentionne bien <\/span><span class=\"s5\">\u00ab une <\/span><span class=\"s5\">maison d\u2019habitation<\/span><span class=\"s5\">\u00a0\u00bb<\/span><span class=\"s5\">, <\/span><span class=\"s4\">l<\/span><span class=\"s4\">e <\/span><span class=\"s4\">N<\/span><span class=\"s4\">otaire <\/span><span class=\"s4\">int\u00e8gre \u00e0 son <\/span><span class=\"s4\">acte un<\/span><span class=\"s4\"> article <\/span><span class=\"s4\">tentant de minimiser <\/span><span class=\"s4\">a priori <\/span><span class=\"s4\">sa responsabilit\u00e9 et intitul\u00e9 <\/span><span class=\"s5\">\u00ab DISPENSE DE <\/span><span class=\"s5\">DOCUMENT D\u2019URBANISME \u00bb<\/span><span class=\"s4\">, contenant les <\/span><span class=\"s4\">mentions <\/span><span class=\"s4\">suivantes <\/span><span class=\"s4\">: <\/span><span class=\"s5\">\u00ab Les parties, et plus particuli\u00e8rement l\u2019ACQUEREUR, ont dispens\u00e9 le notaire soussign\u00e9 d<\/span><span class=\"s5\">e requ\u00e9rir le certificat d\u2019urbanisme, l\u2019ACQUEREUR ayant d\u00e9clar\u00e9 parfaitement conna\u00eetre le bien vendu et avo<\/span><span class=\"s5\">ir pris lui-m\u00eame aupr\u00e8s des services comp\u00e9tents, tous rense<\/span><span class=\"s5\">ignements concernant les r\u00e8gles d\u2019urbanisme s\u2019appliquant \u00e0 l\u2019IMMEUBLE et le d\u00e9charge de to<\/span><span class=\"s5\">ute responsabilit\u00e9 \u00e0 cet \u00e9gard \u00bb<\/span><span class=\"s4\">.<\/span><\/p>\n<p class=\"s3\">\n<p class=\"s3\"><span class=\"s4\">Bien en<\/span><span class=\"s4\">tendu, la cliente ne pr\u00eate pas attention \u00e0 cette clause mais des ann\u00e9es<\/span><span class=\"s4\"> plus tard, lorsqu<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">e<\/span><span class=\"s4\">lle <\/span><span class=\"s4\">tente de remettre le bien immobilier en vente, <\/span><span class=\"s4\">une <\/span><span class=\"s4\">agence immobili\u00e8re <\/span><span class=\"s4\">lui r\u00e9v<\/span><span class=\"s4\">\u00e8le que l<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">immeuble<\/span><span class=\"s4\"> se situe <\/span><span class=\"s4\">dans une <\/span><span class=\"s4\">zone<\/span><span class=\"s4\"> dans laquelle sont interdites les constructions \u00e0 usage d<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">habitation<\/span><span class=\"s4\">\u00a0<\/span><span class=\"s4\">:<\/span><span class=\"s4\"> l<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">immeuble est en r\u00e9alit\u00e9 l<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">ancienne maison d<\/span><span class=\"s4\">u gardien d<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">une usine.<\/span> <span class=\"s4\">Bien entendu,<\/span><span class=\"s4\"> cela r\u00e9duit con<\/span><span class=\"s4\">sid\u00e9rablement la valeur de l<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">immeuble<\/span><span class=\"s4\">.<\/span><\/p>\n<p class=\"s3\">\n<p class=\"s3\"><span class=\"s4\">L<\/span><span class=\"s4\">e<\/span> <span class=\"s4\">N<\/span><span class=\"s4\">otaire a<\/span> <span class=\"s4\">l\u2019obligation \u00e9l\u00e9mentaire de v\u00e9rifier l&rsquo;\u00e9tendue des droits transmis, dont la nature du bien vendu<\/span><span class=\"s4\">, qui s<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">\u00e9tabli par simple <\/span><span class=\"s4\">demande<\/span> <span class=\"s4\">de<\/span><span class=\"s4\"> certifica<\/span><span class=\"s4\">t d\u2019urbanisme.<\/span><span class=\"s4\">L\u2019omission d\u2019une formalit\u00e9 <\/span><span class=\"s4\">aussi <\/span><span class=\"s4\">essentielle constitue <\/span><span class=\"s4\">de jurisprudence <\/span><span class=\"s4\">c<\/span><span class=\"s4\">onstante <\/span><span class=\"s4\">une faute engageant <\/span><span class=\"s4\">s<\/span><span class=\"s4\">a responsabilit\u00e9<\/span><span class=\"s4\">, u<\/span><span class=\"s4\">n Notaire n\u2019ayant pas rempli ses obl<\/span><span class=\"s4\">igations de v\u00e9rification, d\u2019information et de conseil pour assurer la s\u00e9curit\u00e9 juridique de la transaction <\/span><span class=\"s4\">dont il a r\u00e9dig\u00e9 l\u2019acte <\/span><a name=\"_Hlk12626454\"><\/a><span class=\"s4\">priv<\/span><span class=\"s4\">ant<\/span><span class=\"s4\"> les acqu\u00e9reur<\/span><span class=\"s4\">s de l\u2019opportunit\u00e9 de renoncer \u00e0 la vente litigieuse<\/span><span class=\"s4\">.<\/span><\/p>\n<p class=\"s3\">\n<p class=\"s3\"><span class=\"s4\">C\u2019est ex<\/span><span class=\"s4\">actement le cas de l\u2019esp\u00e8ce car jamais la <\/span><span class=\"s4\">cliente<\/span><span class=\"s4\"> n\u2019aurait achet\u00e9 cet immeuble si elle avait su qu\u2019il <\/span><span class=\"s4\">n\u2019avait pas pour nature un<\/span><span class=\"s4\">e<\/span> <span class=\"s4\">mais<\/span><span class=\"s4\">on<\/span><span class=\"s4\"> d\u2019habitat<\/span><span class=\"s4\">ion, et encore moins si elle avait su que sa valeur \u00e9tait <\/span><span class=\"s4\">consid\u00e9rablement <\/span><span class=\"s4\">inf\u00e9rieure<\/span><span class=\"s4\"> de ce fait<\/span><span class=\"s4\">.<\/span><\/p>\n<p class=\"s3\">\n<p class=\"s3\"><span class=\"s4\">C<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">est dans ces cir<\/span><span class=\"s4\">constances <\/span><span class=\"s4\">que le Notaire a \u00e9t\u00e9 condamn\u00e9 \u00e0 des sommes importantes aux titres des pr\u00e9judices mat\u00e9riels et moraux <\/span><span class=\"s4\">subis par<\/span> <span class=\"s4\">la cliente<\/span><span class=\"s4\">, ainsi qu<\/span><span class=\"s4\">\u2019<\/span><span class=\"s4\">au titre des co\u00fbts <\/span><span class=\"s4\">de <\/span><span class=\"s4\">la proc\u00e9dure.<\/span><\/p>\n<p class=\"s6\">\n<p class=\"s6\"><span
